A–C

Auction

A public sale where buyers bid against each other, with the property sold to the highest bidder. In NSW, auctions are unconditional — there is no cooling-off period once the hammer falls.

Cooling-Off Period

In NSW, buyers who exchange contracts for residential property (outside of auction) have a 5-business-day cooling-off period. During this time, they can withdraw from the contract but will forfeit 0.25% of the purchase price.

Contract of Sale

A legally binding document outlining the terms and conditions of a property transaction. In NSW, this must include required disclosures before a property can be marketed.

D–F

Deposit

Typically 10% of the purchase price, paid upon exchange of contracts. This is held in trust until settlement.

Easement

A legal right allowing someone to use part of another person’s land for a specific purpose (e.g., drainage or access).

Exchange of Contracts

When both buyer and seller sign identical contracts and swap them. This is when the agreement becomes legally binding in NSW.

G–I

Gazumping

A term commonly used in NSW when a seller accepts a higher offer from another buyer after verbally agreeing to a sale but before contracts are exchanged.

Guiding Price

An estimated price range provided for marketing purposes, particularly for auction properties. NSW laws require this to be evidence-based.

Inclusions

Items included in the sale of the property (e.g., dishwasher, light fittings, blinds). These must be clearly stated in the contract.

Joint Tenants vs Tenants in Common

Two ways multiple people can legally own property. Joint tenants own equal shares with rights of survivorship. Tenants in common can own different percentage shares.

Land Tax

A NSW state government tax payable by investors if the total taxable land value exceeds the threshold.

Market Appraisal

An agent’s professional opinion of a property’s likely selling price, based on recent comparable sales and market conditions.

Mortgagee in Possession

When a lender takes control of a property due to loan default and sells it to recover funds.

Off-the-Plan

Buying a property before it is built, based on architectural plans and designs.

P–R

Private Treaty

A method of sale where a property is marketed with a set asking price rather than going to auction.

S–Z

Section 66W Certificate

A legal document signed by a buyer’s solicitor or conveyancer that waives the cooling-off period in NSW.

Settlement

The final stage of the transaction when the balance of the purchase price is paid and ownership officially transfers to the buyer.

Stamp Duty (Transfer Duty)

A NSW government tax payable by the buyer when purchasing property. Concessions may apply for first-home buyers.

Strata Title

A form of property ownership for units and townhouses where buyers own their individual lot plus a share in common property.

Unconditional Contract

A contract for the sale of property that is legally binding and no longer subject to any conditions (such as finance approval, cooling-off, or building and pest inspections). Once a contract becomes unconditional, both the buyer and seller are committed to completing the transaction, subject to the agreed settlement date.

Vendor Disclosure

The legal requirement for sellers in NSW to disclose specific information about the property in the Contract of Sale.
